Welcome to Astawq Mobile Application, a mobile application provided by Astawq LLC. These Terms and Conditions ("Terms") govern your access to and use of the App, including any content, features, and services offered through the App. By downloading, installing, or using the App, you agree to be bound by these Terms.

3. Fees and Pricing

Astawq LLC charges fees for certain services within the App related to classified listings:

• Listing Fee: The cost to post a single Advertisement is ${{ appSettings?.ListingPriceTxt }}.
• Boosting Fee: To "boost" an existing advertisement to the top of the list, a fee of ${{ appSettings?.BoostingPriceTxt }} per boost will apply.
• All fees are non-refundable unless otherwise required by law. We reserve the right to change our pricing at any time.

4. Payment Processing and Security

All payments for advertisements and boosting services are processed through a third-party payment gateway, Stripe Inc. By making a purchase within the App, you agree to Stripe's terms of service and privacy policy.

• Data Security: Astawq LLC does not have access to, nor do we store, your full credit card numbers or sensitive payment credentials on our servers.
• Processing: All payment information is encrypted and handled directly by Stripe Inc. to ensure the highest level of security.
• Liability: We are not responsible for errors or security breaches occurring on the side of the third-party payment processor.

5. Advertisement Lifespan

• Rental Lifespan: By default, all advertisements posted on the App will remain visible for a period of 45 days from the date they go live. Once this 45-day period concludes , the listing status will automatically transition to expired.
• Non-Rental Listings:These advertisements typically stay active for a six-month duration before expiring. In certain cases, we may maintain a listing's active status until the user specifically requests its expiration.
• Boosted Listings: The option to boost a listing becomes available 7 days after it is first went live. Any subsequent boosts also require a 7-day waiting period and can be utilized repeatedly until the listing expires. Upon payment, boosted ads are moved to the top of the category it is listed in.
• Extended Visibility: Advertisers may choose to extend the visibility of their advertisements beyond the default 45-day period by recreating it and paying the full fee again.
• Automatic Removal: If a rental advertisement is not renewed or extended, it will be automatically removed from the App after the 45-day period.

6. Communication Consent

By using the App and posting advertisements, you expressly agree that Astawq LLC and its representatives may communicate with you regarding your ads, account activity, or inquiries.

You consent to receive these communications via Email, SMS/Text Messaging, Direct Phone Calls, and In-App Notifications. Standard message and data rates may apply.

7. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are of legal age to form a binding contract with us and meet all of the foregoing eligibility requirements.

8. Account Registration

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

9. User Content

The App may allow you to submit, upload, post, or otherwise make available content, such as text and images. You retain all rights in and to your User Content. However, by submitting User Content through the App, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, promote, and display your User Content in connection with the operation of the App and our business.

10. Prohibited Conduct

You agree not to use the App for any illegal or unauthorized purpose; impersonate any person; interfere with or disrupt the App; or use any data mining, robots, or similar extraction methods.

11. Intellectual Property

The App and its entire contents, features, and functionality are owned by us, our licensors, or other providers and are protected by United States and international intellectual property laws.

12. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the App will be uninterrupted or error-free.

Astawq LLC is not liable for any damages whatsoever, including but not limited to direct, indirect, incidental, consequential, special, or exemplary damages arising out of your use of the App, including but not limited to loss of profits or data.

13. Indemnification

You agree to indemnify and hold us harmless from and against any and all claims, liabilities, or expenses arising out of your use of the App or your breach of these Terms.

14. Termination

We may terminate your access to all or any part of the App at any time, with or without cause, effective immediately.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall be conducted in Silver Spring, Maryland.

16. Changes to These Terms

We may update these Terms from time to time at our sole discretion. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
